Oregon blogger deals with legal threat
by Matt on Dec 14, 2009 in Legal Issues
Mitch Nolan, an Oregon-based blogger who writes not about his hometown per se, but about the media scene in the area, recently faced an interesting legal threat/situation that really could happen to any of us in the hyperlocal blogging arena. Rather than me trying to sum it up, let me just point you to the link:
KOIN-TV: Delete this tweet or face legal action
Aside from the educational account of what happened, there are a couple legal resources listed in there, too (which is inspiring me to do a separate post). In light of my post last month asking What do you know about blogging & the law?, I thought it might be helpful to share this link with you.
Thx to Ray at My Northwest Journal for the tip.

Hi,
I’d been following your blog, and find a lot of interesting tips here. In light of the articles on legal issues bloggers potentially face, I’d like clear cut clarifications regarding some issues like:
1. If I repost articles from the online version of my local newspapers in my own blog, what may I do/not do? How much of the original content of the online article may I re-post in its entirety without violating copyright laws? Is it enough to change the lead paragraph, then copy the rest of the article and post the “new” article on my blog? Or do I need to re-write the post originally posted in the newspapers website and turn it into a fresh post for my blog? Or do I need to provide attribution?
2. Can I use copyrighted pictures originally posted in the online newspaper of my community and post the same to my blog? Will an attribution to the original author be enough to cover my back?
I hope you can help me understand how far I can go with using other people’s content, and how to go about using them legally.
Thanks.
